Important Information Regarding Vending
THIS AGREEMENT is executed by the undersigned vendor for the benefit of Barwash Crue Foundation. Vendor is participating in The Texas Classic Rockin’ Food Truck Rally (TXFTR) to be held on February 24, 2018 at the Galveston County Fairgrounds in Hitchcock, TX. Vendor hereby agrees as follows: You are renting space from Barwash Crue Foundation. You are responsible for what happens inside that space. You have no rights to utilize the space outside of your lot. There will be parking for your vehicle in the parking lot, not at your lot, unless it is inside your rented space and a part of your set up/display.
The expected attendance is upwards of 10,000 attendees. For the safety of the event attendees, all vendors must be in place by 10:00 A.M. Saturday morning and cannot leave until 10:00 P.M. the day of the event. Vendors can start arriving to set-up the day of the event at 6:00 AM. If extra time is needed, please contact Barwash Crue Foundation and arrangements will be made. Your booth must be open during the entire Texas Classic Rockin’ Food Truck Rally. Vehicle traffic around the booth area will be prohibited after 9:30am.
The overall appearance and presentation of your booth is critical to the overall feeling of the Texas Classic Rockin’ Food Truck Rally and to your retail success. We want to ensure that everyone has the best possible experience. Signage with visible prices is required. The Texas Classic Rockin’ Food Truck Rally Staff determines booth placement. A photograph of the concession set-up and detailed description of products/items to be sold is required with the application before the application can be approved. Barwash Crue Foundation makes the final decision if vendor application is accepted. Ensure your booth space/tent is contained in your area, (including all wires, water barrels, poles, etc.) with a good roof that can withstand wind, rain and other inclement weather. Come prepared for all types of weather. You must secure your booth in case of windy conditions. You will not have space behind your compound, so be sure to factor that in when selecting your lot size. We are providing an asphalt surface so prepare to secure tent accordingly. Specific locations such as “corner spots” are not given out. Generators are allowed as long as they fit in your space. Please let us know in the application if you will be bringing a generator. No PA or Sound Systems are allowed. You are responsible for setting up, maintaining, and removing your own booth, your merchandise and your trash.
SOCIAL MEDIA: We’d love each participant to blast social media with the details of the event. Social media in addition to our own marketing campaign will give each vendor participant the maximum exposure! Please help us get the word out. We request each vendor post to their Twitter, Facebook, Instagram, and Snapchat when they get accepted into The Texas Classic Rockin’ Food Truck Rally and at least 6 posts on their social media pages during the week of the event. Please use the hashtag #TXFTR.
The Texas Classic Rockin’ Food Truck Rally Vendors can select which booth sizes work best for their business. The following options are as follows: Please indicate which package you would like to purchase:
Promotional Table: $85 per event (For approved organizations looking only to promote their company or cause. Sales are not allowed) 10×10 only. Please inquire about other sizes.
2018 Texas Classic Rockin’ Food Truck Rally Vendor Contract Conditions
1) All vendors are required to notify Barwash Crue Foundation of special promotions at their booth. Barwash Crue Foundation reserves the right to disallow any promotion that it deems inappropriate for the presentation of our support to the public. 2) Barwash Crue Foundation reserves the right to modify any aspect of this vendor agreement in order to satisfy specific contractual obligations or restrictions within the venue. 3) Manufacturers cannot sell products they do not manufacture or exclusively distribute in North America. 4) Barwash Crue Foundation will give reasonable notice for any required logos, ads, or information needed to help promote the vendor. 5) Booth space is limited at each of our events. It will be available on a first come, first serve basis according to balances paid. Only paid vendors will be confirmed for the event. 6) All applications must be submitted no later than four weeks prior to The Texas Classic Rockin’ Food Truck Rally. Indemnification Vendor shall defend (if required by Barwash Crue Foundation), indemnify and hold Barwash Crue Foundation, and the officers, directors, agents, employees and assigns ofBarwash Crue Foundation (collectively the “Indemnified Parties”), harmless from and against any and all claims, demands, suits, damages, liabilities, losses or expenses of any nature whatsoever (including, without limitation, attorneys’ fees and costs) arising from or relating to: (a) any act or omission of Vendor, its officers, directors, agents, sub-contractors, employees, invitees, or sponsors (collectively, the “Involved Entities”); (b) a breach of any term or covenant contained herein by the Involved Entities; (c) any advertising or signage installed or authorized by the Involved Entities, if any; (d) any advertising, promotion, sale or other distribution of kind; and/or (e) the use by the Involved Entities of any medical services, including ambulance services, in connection with Vendor’s activities or any Event relating to this Agreement regardless of whether such services were obtained through or provided by the Barwash Crue Foundation The provisions of this paragraph shall survive, indefinitely, the expiration or sooner termination of this Agreement. In executing this Agreement, Vendor acknowledges and represents that Vendor has read the foregoing Agreement including the foregoing Release of Liability and Indemnity agreement and will be bound by this agreement.
